Dismissed educator wants millions in compensation

An educator who was dismissed from Homevale High School in 2017 is seeking millions in compensation from the Department of Education.

AN EDUCATOR who was dismissed from Homevale High School in 2017 is seeking millions in compensation from the Department of Education.

Legal representative, advocate Albert Eillert, said Rentia McGalty was claiming past damages of R1.5 million for loss of income and employment as well as future losses amounting to R10 million.

McGalty testified in the Northern Cape High Court earlier this week that there were no prospects of being employed by the state following her dismissal.

“I was informed that my South African Council of Education (SACE) registration is no longer valid and that I was removed from the roll of educators.”

She added that the Educators Labour Relations Council (ELRC) had found grounds that she had been unfairly dismissed.

“I unsuccessfully applied for several posts including at Pescodia High School, the TVET College and Sol Plaatje University. I had to disclose in the application forms that I had been dismissed.”

McGalty stated that the chief director of operations at the Department of Education, Esley Kistoo, previously warned her that “she would never work at any school in the Province”.

She indicated that she had only managed to secure a temporary position where she taught at a school for 10 months during 2019.

Legal representative for the Department of Education, advocate Mthembu, stated that McGalty had failed to submit the relevant documents to the SACE and that the department was not responsible for removing her name from the educators roll.

“The department wrote to the SACE to enquire why McGalty was removed. It is illogical to write to SACE if the department had applied for her removal.”

Mthembu pointed out that McGalty had entered into a settlement agreement with the department following her dismissal.

“Following her dismissal, McGalty turned down an offer that was made to her for an educator position.”

The case continues before Judge Mpho Mamosebo.
